II- GENERAL CONDITIONS OF USE

 

 

1. Purpose of the Site

 

The PARFETIQUE website (hereinafter the "Site") is an e-commerce site that offers perfumes of different brands for sale to Internet users browsing the Site (hereinafter the "Visitor(s)"). This Site is accessible via the Internet at the address www.jovoyparis.com ;

PARFETIQUE collects personal data in the context of this Site.

3. Intellectual Property

The reproduction of all or part of the Content is authorised solely for the purposes of information for personal and private use, any reproduction and any use of copies made for other purposes in any manner whatsoever and in any form whatsoever being expressly prohibited. You may not copy, modify, create a derivative work of, assemble, decompile (except as permitted by law), sell, assign, sublicense or otherwise transfer any rights in the Content. It is also forbidden to modify all or part of the Content and in particular the software or to use modified versions of the software with a view in particular to obtaining unauthorised access to the service and to accessing the Site by any means other than the interface provided to the Visitor by PARFETIQUE for this purpose.


3.2 Trademarks

 

It is recalled that PARFETIQUE is the owner of the JOVOY brand and its logos.

The Visitor acknowledges the exclusive rights of PARFETQUE to the JOVOY brand and undertakes not to make any use whatsoever of it and more generally to infringe the intellectual property rights of PARFETIQUE. PARFETIQUE reserves the right to claim damages in the event of infringement and more generally of its intellectual property rights.


All other brands or logos appearing on the Site are the property of either PARFETIQUE or its service providers, partners or suppliers. Any use, in any way whatsoever, of these brands and/or logos and/or any other Content is subject to the express prior authorisation of PARFERIQUE or the holder of the intellectual property rights concerned.


3.3. Hypertext links


The Site may include links to other websites or other Internet sources. Insofar as PARFETIQUE cannot control these external sites and sources, PARFETIQUE cannot be held responsible for the availability of these external sites and sources, and cannot be held responsible for the content, advertising, products, services or any other information or data available on or from these external sites or sources. Furthermore, PARFETIQUE cannot be held responsible for any damage or loss, whether proven or alleged, resulting from the use of or reliance on the content, goods or services available on these external sites or sources.


Any creation of links to the PARFETIQUE Site, any framing of the Site, and more generally any use of an element of the Site, is subject to the prior and express authorisation of PARFETIQUE which may be revoked at any time at its sole discretion. PARFETIQUE reserves the right to (i) request the deletion of any link to the Site that has not been, or is no longer, authorised and (ii) claim damages as compensation for the loss suffered as a result.

 

4. Visitor Behaviour

 

Each Visitor must use the Internet responsibly, with respect and courtesy towards the rights of other Internet users.


In this respect, the Visitor, by accessing the Site, is prohibited from


- upload to the Site, post, email or otherwise transmit any unlawful, harmful, threatening, abusive, harassing or tortious material,

 

defamatory, vulgar, obscene, indecent, invasive of a person's privacy, including image rights, offensive or derogatory, or racially, ethnically or otherwise objectionable;

- upload to the Site, post, email or otherwise transmit any material that contains software viruses or other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;


- disrupt or interrupt the Site or servers or networks connected to the Site, or violate any requirements, procedures, rules or regulations of networks connected to the Site;


- attempt to interfere with the service of any user, host or network, including but not limited to, exposing the Site to a virus, creating a flood, flooding the server, overloading the e-mail system or forging any TCP/IP packet header information or any part of the header information in any e-mail;


- accessing data that is not intended for the Visitor or entering a server/account that the Visitor is not authorized to access;


- attempt to probe, scan or test the vulnerability of a system or network, or to breach security or authentication measures without authorization;


- impersonating another person;


- carry out an activity or incite a third party to carry out an illegal activity or any other activity that would infringe the rights of PARFERIQUE, its suppliers, partners, distributors, advertisers or any other Visitor;


- transmit or transfer (by any means whatsoever) any information or software derived from the Site, in particular to other countries or to certain foreign nationals in violation of any national or international law or regulation.


Recognizing the global nature of the Internet, each Visitor agrees to abide by all local and international rules and procedures regarding online behavior and acceptable content, including all applicable laws regarding the transmission of technical data.


At any time and for any reason whatsoever, PARFETIQUE may implement any means enabling it to terminate, without prior notice, the Visitor's use of the Site or any of PARFETIQUE's services for any conduct that violates these terms of use, without prejudice to any damages that PARFETIQUE reserves the right to claim from the Visitor in the event of non-compliance with these general terms of use of the Site.

 

 

5. Responsibility


5.1. Access and operation of the Site

 

The Visitor is personally responsible for setting up the computer and telecommunications resources needed to access the Site and for the knowledge needed to use the Internet and access the Site. The Visitor retains the connection and equipment costs related to accessing the Internet and using the Site at his own expense.


The Visitor uses the Site at his own risk. PARFETIQUE may not therefore be held liable for any damage that any Visitor may suffer as a result of such use.

 

In addition, PARFETIQUE declines all responsibility for indirect damage, whatever the cause, origin, nature or consequences, including in particular the costs that may arise from the acquisition of goods proposed on the site, the loss of profits, customers, data or any other loss of intangible property that may arise from the access of any person to the site or the impossibility of accessing it, or from the credit given to any information originating directly or indirectly from the latter.

 
5.2. Limitation of liability


The Site also contains information from third parties and links to other websites. PARFETIQUE has no control over the accuracy of the information contained therein or its content. Accordingly, PARFETIQUE shall not be liable for any damages resulting from the use of, access to, or inability to use such third-party information or the content of other websites.

PARFETIQUE shall not be held liable for any guarantee of any kind, whether implicit or explicit, concerning in particular the integrity, accuracy, timeliness, non-infringement, availability, reliability or completeness of the information, products, accessories or services appearing on the Site, nor their suitability for the use that the Visitor intends to make of them.


Any claim filed by a Visitor against PARFETIQUE must be made within six (6) months of the occurrence of the event, which is the subject of the claim.

 

6. General


6.1. Modifications


PARFETIQUE reserves the right to modify and update the General Terms of Use without prior notice. In order to be informed of any such changes, PARFETIQUE advises the Visitor to reread the GTCU regularly. Use of the Site will be subject to the GTC in force at the time of use.


6.2 Completeness


In the event that one of the clauses of these GTUs would be null and void due to a change in legislation, regulation or by a court decision, this would not affect the validity and respect of the other clauses of the GTUs.


6.3. Applicable law


The present GTU are subject to French law.


Any dispute relating to the existence, interpretation, performance or breach of the contract concluded between PARFETIQUE and the Visitor, even in the event of multiple defendants, shall, in the absence of amicable agreement, be subject to the exclusive jurisdiction of the Courts of Paris. This attribution of jurisdiction is valid notwithstanding the plurality of defendants or guarantee appeals, even for emergency procedures or protective procedures in summary proceedings or by petition.
